The 2026 CMS final rule introduces updates to how we certify and document eligibility for hospice services to ensure high standards of accountability and care. While the core mission of providing comfort and dignity remains unchanged, the new regulations strengthen the physician encounter attestation requirements.
Under these updated rules, either the attending physician or the hospice medical director must conduct a face-to-face encounter to certify that a patient continues to meet the criteria for a terminal illness. This attestation must now explicitly include:
- The clinical findings that support the terminal prognosis.
- Confirmation that both the patient and their family have been informed of their continued eligibility.
Furthermore, the transition to the Hospice Outcomes and Patient Evaluation (HOPE) tool replaces the previous Hospice Item Set (HIS). This change shifts the focus from administrative, retrospective chart reviews to real-time, clinical point-of-care assessments. This allows our multidisciplinary team—including our nurses, social workers, and therapists—to capture a more comprehensive and accurate picture of a patient’s journey and symptoms directly during their care.
Please note that eligibility for hospice must be determined by a physician, and a physician certification is required. Because care is individualized, outcomes may vary, and we recommend consulting with a healthcare professional for specific clinical decisions. Our team in Michigan is available to help you navigate these Medicare documentation requirements and ensure your loved one receives the benefits they deserve.
